AMERICAN ENERY RESTAURANT EQUIPMENT (“AERE”) warrants your used equipment (and certain new equipment that is no longer covered by manufacturer’s warranty at time of your purchase) purchase against defects in material and workmanship under normal use and maintenance service for the term listed on your invoice from the date of sale and provided the used equipment is kept within a 60-mile radius of AERE’s office. AERE will at its option 1) provide materials and labor at no charge to repair the equipment or 2) refund the purchase price of the equipment provided the defect is reported to AERE within the term of this Limited Warranty. Only AERE or its authorized service agency may perform warranty service.
This Limited Warranty is provided to the original purchaser of the equipment only and is not assignable or transferable to any other party. To qualify for the warranty your equipment must be installed by a certified foodservice equipment technician if the equipment has gas, water, 208V (or higher), or 3-phase electrical connections. This warranty does not cover wear and tear, customer’s misuse, mishandling or failure to perform regular maintenance. This is the complete warranty for the equipment and sets forth the full extent of AERE’s liability to the purchaser and responsibilities regarding the equipment. The repair of the equipment or refund of the purchase price, at the sole option of AERE, is the exclusive remedy.
THIS WARRANTY IS GIVEN IN LIEU OF ALL OTHER EXPRESS OR IMPLIED WARRANTIES, INCLUDING, WIHTOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILTY AND FITNESS FOR A PARTICULAR PURPOSE. IN NO EVENT SHALL AERE BE LIABLE FOR DAMAGES IN EXCESS OF THE PURCHASE PRICE OF THE EQUIPMENT. AERE SHALL NOT BE LIABLE FOR ANY LOSS OF USE, LOSS OF TIME, INCONVENIENCE, COMMERICAL LOSS, LOST PROFITS OR SAVINGS OR OTHER INCIDENTIAL, SPEICAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF THE USE OR INABILTY TO USE THE EQUIPMENT.
This Limited Warranty may only be modified in writing and if signed by James P.Strickler on behalf of American Energy Restaurant Equipment.
